1. Agreement to Terms

By accessing or using CONSTRUCT ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

CONSTRUCT is a desktop application that provides integrated workspaces for design, code, collaboration, and AI-assisted development. The Service includes built-in spaces, AI agents, a developer platform for custom spaces, and team collaboration features.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials.

4. Subscription and Payment

CONSTRUCT offers a free Personal plan with bring-your-own API keys. Team and Enterprise plans are billed on a per-organization basis. You may cancel at any time; access continues until the end of the billing period.

5. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

6. Restrictions

You may not: reverse engineer the Service; use it for illegal purposes; share account credentials; attempt to gain unauthorized access; use automated systems to access the Service; modify or create derivative works; remove proprietary notices; or use the Service to compete with us.

7. Your Content

You retain ownership of all content you create using the Service. We do not claim ownership over your designs, code, or other materials.

8. AI Features

AI features process data through third-party providers (OpenAI, Anthropic). Data sent to AI providers is subject to their respective privacy policies. AI-generated outputs are provided as-is without warranty.

9. Intellectual Property

CONSTRUCT and its original content, features, and functionality are owned by Basecode and are protected by international copyright, trademark, and other intellectual property laws.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

11. Limitation of Liability

In no event shall Basecode be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States.
